STORE REWARDS TERMS AND CONDITIONS

Effective Date: January 1, 2019.

READ THESE TERMS AND CONDITIONS CAREFULLY. INDIGO PAYMENTS, INC HOSTS STORE REWARDS PROGRAMS FOR RETAILERS. BY ACCESSING OR PARTICIPATING IN A STORE REWARDS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ALL TERMS INCORPORATED BY REFERENCE AS DESCRIBED BELOW. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR PARTICIPATE IN A RETAILERS STORE REWARDS PROGRAM.

These Store Rewards Program Terms and Conditions (“Rewards Terms”) apply to your access to and participation in each retailers Store Rewards Program (“RewardsProgram”), which is hosted by Indigo Payments, Inc. (“Indigo”) and operated by the retailer or its affiliates (collectively, “Retailer“, “our”, “us” or “we”). These Rewards Terms do not alter in any way the terms or conditions of any other agreement you may have with Retailer or Indigo for other products and services. Please note that your access to and participation in the Rewards Program is also governed by the terms, conditions, limitations and requirements linked in these Rewards Terms, all of which (as may be changed over time) are incorporated into these Rewards Terms.
Retailer reserves the right to change, modify and/or eliminate the Rewards Program and/or all or any portion of these Rewards Terms or any policy pertaining to the Rewards Program at any time and in its sole discretion, including its right to discontinue or change eligibility requirement, point accumulation formulas, giveaway rules, rewards offered, redemption requirements, expiration of points under the Rewards Program or merge the Rewards Program with another rewards program. It is possible that you may be unable to receive enough Rewards Points to redeem a reward if we discontinue the Rewards Program or merge the Rewards Program into another rewards program. If we make changes, we will update the Retailer Reward page on my.IndigoCCR.com or if applicable, post the amended Rewards Terms to http://my.IndigoCCR.com/Store-Rewards-Terms and update the “Effective Date” above. We may also attempt to notify you in other ways. Unless we say otherwise, the amended Rewards Terms will be effective immediately and your continued participation in the Rewards Program after the amended terms are posted will confirm your acceptance of the changes. If you do not agree to the amended Rewards Terms, you must stop participating in the Rewards Program.

1. Rewards Program Eligibility

You must be a United States resident (including residents of U.S. Territories) who is at least 18 years of age to participate in the Rewards Program. The Rewards Program is intended for personal use only, and commercial use by commercial customers and others purchasing items for resale are not eligible to participate in the Rewards Program. Current Retailer employees and contractors, and their immediate family members living in the same household, are not eligible to participate in the Rewards Program.

Please review our Privacy Policy, which also governs your visit to the my.IndigoCCR.com website, to understand our practices.

3. Rewards Program Description

The Rewards Program is a free customer loyalty program that allows participants to earn “Rewards Points” with qualifying purchases at Retailer locations or websites. Participants may also earn Rewards Points by participating in Promotional Activities (defined in Section 5) that may be offered through the Rewards Program from time to time. Participants in the Rewards Program may redeem accumulated Rewards Points at Retailer locations or websites. Participants may also use Rewards Points for other purposes as may be provided by Retailer from time to time. These Rewards Terms provide a general overview of the Rewards Program. For more information about earning, calculating or redeeming Rewards Points, Promotional Activities and other details, please visit the Retailer Reward page on my.IndigoCCR.com.

4. Joining the Rewards Program

There are no membership fees associated with the Rewards Program. Below are some of the ways that you can enroll in the Rewards Program. For more information about enrolling in the Rewards Program, contact the Retailer or Indigo.
1. Providing your phone number and/or email to a Retailer at checkout.
2. Opting into the Rewards Program when initiating an online purchase.
3. Converting from a Retailers existing loyalty program to the Rewards Program.
4. Join the program on the Retailer’s login page hosted on my.IndigoCCR.com (contact Retailer for complete URL).

Once you are enrolled in the Rewards Program you may access my.IndigoCCR.com to confirm your account information and accept the Rewards Terms. Confirming your account may be required to accumulate and/or redeem rewards, check the Retailer Reward page for details.

Confirming your account is required to be eligible for promotional SMS and email messaging from Retailers. You can manage your Rewards Program account (“Rewards Program Account“) by logging in on the my.IndigoCCR.com website.

You may only have one Rewards Program Account per Retailer, and it is nontransferable. You are responsible for anyone else who uses your Rewards Program Account.

5. Earning Rewards Points

The benefits that are available to you through the Rewards Program are based on the number of Rewards Points you earn by making qualifying purchases at the Retailer or otherwise participating in Retailer’s Reward Program Promotional Activities.

Purchases. In order to receive Rewards Points for a purchase, your Rewards Program phone number and/or email must be provided to the clerk at checkout or included in the transaction information for online sales. You earn Rewards Points based on the total amount paid for your purchase, excluding any tax and shipping. For more details about how to earn Rewards Points by making qualifying purchases, please visit the Retailer’s Rewards page.
Promotional Activities and Events. From time to time, we, or others acting with our permission, may offer you opportunities to earn bonus Rewards Points, such as inviting you to engage with Retailer in special promotional events or activities in exchange for Rewards Points (“Promotional Activities”).
For further details on Promotional Activities please visit the Retailer’s Rewards page. Rewards Points for participation in Promotional Activities will be awarded as described in the applicable promotional offer and will be subject to any additional terms set forth in the promotional offer. Some Promotional Activities may limit the amount of Rewards Points earned per Promotional Activity. Rewards Points for eligible participation in Promotional Activities may take seven or more days to be added to your Rewards Program Account.

6. Redemption of Rewards Points

You can redeem Rewards Points posted to your Rewards Program Account for discounts and coupons, which can be applied at time of checkout by telling the clerk you would like to redeem points. For details of redemptions available please visit the Retailer’s Reward page on my.IndigoCCR.com.

Rewards Points accumulated under the Rewards Program and redemptions are promotional in nature and have no cash value. Redemptions are redeemable in merchandise only and cannot be applied to previous purchases. Your Rewards Points, Redemptions and your Rewards Program Account are personal to you and may not be sold, transferred (by operation of law or otherwise) or assigned to or shared with, family, friends or others, or used by you for any commercial purpose. You are responsible for any federal, state or local taxes applicable to your participation in the Rewards Program.

7. EXPIRATION OF REWARDS POINTS

EACH RETAILER’S EXPIRATION POLICY IS AVAILABLE ON THE RETAILER’S REWARD PAGE PUBLISHED ON MY.INDIGOCCR.COM

8. Impact of Merchandise Returns on Your Rewards Points and Redemptions

If you return merchandise that you purchased with Redemptions in accordance with the Retailer’s Return Policy, you will be refunded the amount you paid (excluding the value of Redemptions and any other discounts) to the original method of payment. For example, if you placed an order totaling $100 for one item and used a $10 Redemption, the Retailer will refund $90 to your original method of payment. If you purchase multiple items using a single Redemption, then the value of the Redemption is applied proportionally to each item, and returns of any one item will result in a refund of the amount you paid for the item, excluding the value of the proportionally applied value of the Redemption. You will not receive a replacement Redemption for returned merchandise and the Retailer will not credit the redeemed Rewards Points back to your Rewards Program Account.
If you void a purchase or return your purchase, Retailer will deduct the Rewards Points that you were awarded for that purchase from your Rewards Program Account. If you have already redeemed those Rewards Points, this could potentially result in a negative Rewards Point balance in your Rewards Program Account.

9. Communications

Prior to confirming your account, you may receive one to three SMS messages from the Retailer’s toll free number and/or emails inviting you to join the rewards program. Once confirmed you may choose communication preferences in the Account Information section of your Rewards Program Account. You can choose to accept email, SMS, both or none. Future communication pertaining to rewards transactions or administration of the Rewards Program are sent via the Retailer’s toll free number or email based on your communication preferences.

If you have confirmed your account and choose to accept SMS messages for promotional opportunities, messages from Retailers will come from short code number 45791.

Messaging Policy for Promotional SMS. Participating carriers include: AT&T, Boost Mobile, T-Mobile, Metro PCS, Verizon Wireless, Sprint, U.S. Cellular, Nextel & Virgin Mobile. Carriers are not liable for delayed or undelivered messages. Retailer and Indigo are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive a maximum of 5 promotional communications per week from a Retailer. The total number of messages you receive each week will vary based on the number of Retailer Reward Prorgrams you are enrolled in. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

T-Mobile is not liable for delayed or undelivered messages.

You can cancel the SMS service at any time. Just text “STOP” to 45791. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If at any time you forget what keywords are supported, just text “HELP” to 45791. After you send the SMS message “HELP” to us, we will respond with instructions on how to use our service as well as how to unsubscribe. You may also contact Indigo support at: +1 (800) 988-8386.

10. Miscellaneous

Without notice to you, Retailer reserves the right to suspend or terminate your Rewards Program Account and/or your participation in the Rewards Program (in whole or in part), if Retailer determines in its sole discretion that you have violated these Rewards Terms, you have more than one Rewards Program Account, or that the use of your Rewards Program Account or your participation in the Rewards Program is unauthorized, abusive, deceptive, fraudulent or otherwise unlawful. Retailer may, in its sole discretion, suspend, cancel or combine Rewards Program Accounts that appear to be duplicative. In the event that your participation in the Rewards Program is terminated, you will not be able to redeem any accumulated Rewards Points.
Without notice to you, Retailer also reserves the right to “unregister” a Rewards Program Account that is inactive and cause that Rewards Program Account to be ineligible for the Rewards Program. In the event that your Rewards Program Account is unregistered due to inactivity, then you will no longer be eligible for Rewards Program benefits, including accumulating Rewards Points or Redemptions. You may reactivate your Rewards Program Account by logging into your Rewards Program Account or making a purchase using your Rewards Program Account, but any Rewards Points earned prior to the Rewards Program Account being deemed inactive will be voided.
